Marco Polo and Ponce de Leon

My two explorers are Marco Polo and Ponce De Leon. Marco Polo was one of the most famous westerner travelers. He traveled across Asia. He sailed south from Venice, Italy in the Mediterranean Sea. He also explored an area south of Beijing and the coast of china which is now Vietnam. Ponce de Leon sailed for Florida in the Americas. The reason why Marco Polo did his exploration was to find all kinds of different goods to trade. He did this because he was learning about trading goods. He was able to find perfumes, jewels, porcelain, and silk garments. He made lots of money while he stayed in Khan’s court. Pone de Leon’s reason for his expedition was because he was hurt by the king’s action for making Columbus’ son governor so he sailed off. Also he reason was to find new lands and treasures. Another thing was the Fountain of Youth, which was a mythical spring that the Indians spoke of.The Fountain of Youth was believed to make older people young again. Some of Marco’s hardships came when he was traveling to the Gobi Desert. It was hard without camels and was very hot. It was also hard not having food or water. Some times Marco felt like he was in a dream because he would hear frightening sounds, he would see ghost figures of his friends, and was having weird illusions. Some of Ponce de Leon’s hardships that he faced where he was ambushed by the Calusa Tribe. He was ambushed by them on his way back to Florida to start a farming colony. He was shot in the thigh by an arrow and was seriously wounded, so they decided to sail back to Cuba. The result of Marco’s expedition was that he ended up in prison because he was in war against the Genous and was captured. The result of Ponce de Leon’s expedition was that he never found the gold or the mythical fountain. Also he died at 61 because of he serious wound.

Commercial Contracts Under Nigerian Legislation

COMMERCIAL CONTRACTS UNDER NIGERIAN LEGISLATION Introduction A contract is an agreement which is legally binding on the parties to it and which if broken may be enforced by action in court against the party that has broken it. A contract may be void or voidable. A void contract is that which lacks the essential ingredients or elements of valid contract and therefore of no legal effect. A voidable contract is that which is valid in the first place but may be ended at the instance of one of the parties to it.Such contracts include guarantee with a bank of money lender, hire purchase and sale or leasing of land. The legal consequences of non-compliance are that they are not enforceable at law though they are not necessarily void. However, some categories of contracts must of necessity be in writing or else they shall be void absolutely. These include transfer of shares, marine insurance and hire purchase agreements. As a general rule also, all contracts are in the nature of agreement: h owever, not all agreements may constitute a contract properly so called. For instance, an agreement for the sale of a parcel of land is intended to be binding and enforceable at law, whereas, an invitation to a luncheon which after all, did not hold may not be enforceable at the suit of the disappointed party. A contract may also be under-seal or by deed and may be simple or oral. It may be express when it is written or implied when it is inferred from the conduct and acts of the parties. In addition, there can be bilateral contract between two parties or multi-lateral contract among parties depending on the nature of obligations to be performed under the agreement.Condition and warranty are the two basic types of express terms in a contract. Whether a term is a condition or warranty depends on the intention of the parties. A condition is a vital term which goes to the root of the contract. Breach of a condition entitles the innocent party to repudiate the contract and to claim damag es. A warranty is a term which is subsidiary to the main purpose of the contract, breach of which only entitles the innocent party to damages. FORMATION OF A VALID CONTRACT The main requirements of a valid contract are as follows: 1. there must be an offer; . there must be an acceptance; 3. there must be consideration; 4. parties must have full contractual capacity; 5. there must be an intention to create legal relations; 6. object of the contract must not be unlawful nor illegal; 7. prescribed formalities must be followed, for example, it should be in writing or by deed. Forms of Contract Contract supported by consideration are essentially expected to be in writing,. It is however important to note that a contract may also be oral or implied and yet be binding on the parties depending on the peculiar circumstances. The fact remains that a contract may not be taken as being invalid or unenforceable for the mere fact that it is not in a written form. Te court would normally not assist any person who was lured into an oral agreement. Writing merely facilitates the interpretation or proving of the terms of the contract barring which it may not be all that necessary. In considering commercial contracts under Nigerian legislation however, we would evaluate three of such contracts which are: ? hire purchase; ?sale of goods; ?agency. AGENCY CONTRACT IntroductionAgency is a relationship that exists between two persons, one of whom expressly or impliedly agrees that the other should represent him or act on his behalf. The one that is represented is called the principal while the person representing or acting on somebody’s behalf is called Agent. Agency relationship involves the consent of the agent and the principal that one should act for the other. It thus arises from a contract or agreements express or implied. Ofodile v. Chinwuba Generally, the relationship of principal and agent may arise in three main ways: 1.By agreement , whether contractual or not expres s or implied in nature 2. By subsequent ratification by the principal of the agent’s act done on his behalf, and 3. By operation of law under the doctrine of necessity Whether or not an agency relationship exists would largely depend on the true nature of the agreement and the circumstances of the relationship between the principal and the agent. In another vein, the law of agency consists of the law of the employer and the employed, where the employment consists of bringing the employer into contractual relationship with the third party. This relationship is simply referred to as â€Å"The Master and Servant† relationship under the labour law and for which there is a vicarious liability. An agent should be distinguished for an independent contractor. An independent contractor is the person who negotiates with the third party on his own behalf. An independent contactor is a person liable to give contract for service while and agent or servant renders contract of service . An independent contractor is personally liable at law for his actions. An agent is not a trustee of the goods in his care not being the legal owner. The extent or scope of the Agent’s discretion is determined by his principal’s instructions. Legal title always remains in the principal. An agent can therefore not give good title all by himself. CLASSIFICATION OF AGENCY a. Special Agent: This is someone who has authority to do some particular act on behalf of his principal though not a continuous basis; for instance, a special order to purchase a house or a vehicle. b. General Agent: this is someone who has power to act for his principal in all matters involving business or trade, for example a solicitor or legal practitioner. . A Factor Agent: He is an agent who sells or disposes of goods that are entrusted to him. His activities are governed by the Factors Act 1889 (UK d. Broker Agent: He negotiates ad makes contract for the sale and purchase of goods. However unlike a factor he is not left in possession of the goods. Typical example is insurance Brokers and Stock Brokers. e. Universal Agent: This is someone who represents various principals in many aspects of trade. He is appointed by a Deed under Power of Attorney and has wide powers. f.Mercantile Agent: He represents someone in commercial and certain aspects of trade. Their duties are more or less similar to those of the factor agent g. Auctioneer: He represents a principal in the disposal of real properties. They are usually licensed to sell properties of Mortgagors who have defaulted in payment. Auctioneer acts between the Vendor and the purchaser. He receives commission and invariably sells to the highest bidder. h. Estate Agent: These deal in the acquisition of, valuation of an disposal of properties i.Del-Credere Agent: This is a mercantile agent who, in consideration of extra pay, that is del-credere commission guarantees to his principal that the 3rd party with whom he enters into cont ract on behalf of the principal shall duly pay the sum becoming due under the contract. In effect a del credere agent is a surety of the person with whom he deals. This is just a form of guarantee which may not necessarily be in writing in order to be enforceable at law. CREATION OF AGENCY It may be created in two broad ways namely: (a)Expressly and (b) impliedly a. Express Creation: . By deed – this involves issuing an authority in writing with the necessary instruction and attestation clauses. That is signed, sealed and delivered. This process is known as the granting a Power of Attorney. 2. Oral instruction – This is agency by appointment, it deals with express authorisation of the principal to the agent to act for him b. Implied Creation 1. Agency of necessity – This is created by act of person who normally had no authority but was compelled to reasonable act to protect the interest of the 3rd party especially during an emergency situation. 2.Agency by Estop pel: – This is a type of agency that can be inferred form the conduct of the parties. If the situation that exists suggests that parties want to create an agency relationship, either of the parties is stopped form denying the existence of such a relationship. 3. Apparent Agency – This occurs where a principal has not taken due precaution to prevent a situation where somebody portrays himself as having power to act as his agent. 4. Agency by ratification – This occurs where the principal having full knowledge of the fact, accepts the benefits of the contract entered into by his apparent agent.Any act whether lawful or unlawful may be ratified provided it is not void. If it is voidable it is still capable of being ratified as long as it is valid. In Brook v. Nook where an agent forged his principal’s signature on a promissory note; it was held that the attempt at ratification was void. The principal must have capacity as at the date of the contract. In Keln er v. Baxter where a promoter tried to ratify some pre-incorporation contracts it was held that he could not succeed as the contracts predated the company.

Key Characteristics of Natural Knibbles Orientation Program Essay - 1

Key Characteristics of Natural Knibbles Orientation Program - Essay Example The researcher states that since the organization was trying to expand its markets by penetrating into new markets and improving on its profit margins, this required modifying its human resource strategies as well. The main focus was given on improving on employee productivity and performance by making them more efficient. Thus the orientation program was also found to be characterized by changes in the existing equipment and systems and changes in the production processes. The orientation program also demonstrates a training centric approach taken by the management to help employees adapt to the new work structures, equipment, work procedures, and processes. The objective was to equip employees with optimum resources and technologies so that they could use them efficiently and yield the result that was desired in the organization. This is because the new strategic direction that Natural Knibbles had undertaken required the organization’s workforce to attain a greater and a hi gher performance level, Thus it is seen that all key activities of the company were aimed towards aligning organizational functioning with its long-term objectives. Since both Kane and Liza were new in the organization, they were required to be made aware of the organizational goals and objectives clearly before they were introduced to the work procedures. More importantly, they needed to be acclimatized with the work culture existing within the organization and adapt themselves to the same. In other words, they required proper induction training in which they would be informed about the employer’s business, the various terms and conditions of their services and clear idea about the duties and responsibilities that they would have to deliver. Since Kane was without any tertiary qualification, on the job training would be the optimum best option for him. However, this would have to be an experienced instructor who would be only involved with every small detail and requirements in the process. The buddy system does not appear to be optimum because although he would have the requisite knowledge and experience about the job, he would also have his own set of regular responsibilities.

Introduction to management Essay Example | Topics and Well Written Essays - 1000 words - 1

Introduction to management - Essay Example This scenario may be referred as dynamicity of the environment. The shorter termed opportunities and speculation points cannot be integrated in the previously designed strategic plan of the organization (Steed, 2013). Conventional strategic plans are not flexible to absorb the environmental developments while the previous plan is being implemented. The strategic plans are result oriented, but the minor flexible slots can provide the short term advantage to the competitors. The environment of the organization apparently remains unchanged and stationary. The previously stated phenomenon creates rigidity because of mission and vision statements. Mission and vision statement are the guides for future time period. The frame work for future time is usually for longer time period and once it is created, no one can add newer dynamics into the objectives’ timeline. However it is not a rule of thumb because some strategic plans have the capability to recognize the importance of the envi ronment but only to the extent of locked in objectives. The extent of absorbability is not significant to compete over the cutthroat bases (Burus, 2013). Strategic planning possesses vital importance in the strategic success of an organization. There are meaningful rationales behind creation of strategic plans. Foremost, the strategic plans provide an enlightened way to create the organizational goals fulfilled. It puts the synergy in to the organizational energies by providing a leading path definition. The leaders within the organizations have clear idea of expected output from the subordinate and the employees gain a transparent spirit of anticipations. The exchange of expectations creates a bridge like roadmap through which the organization personnel lead their tasks. The concept of cross functional work teams and self managed teams has significantly twisted the scenario. Increasing competition has augmented the need of organizational commitment and innovative environment. For e xample, Google Incorporation provides one an hour to its employees which is spare of the routine tasks so that they can have a brain storming session and come up with the innovative ideas. Recognizing the importance of the strategic planning, we cannot recommend letting the strategic plans go. It needs to create integration with dynamicity of the environment with the organizational strategic plan (Steed, 2013). Leading innovative organizations in the world are leaning to transfer their organizational structures from mechanistic to organic ones. The flatter organizational hierarchies provide a wider room for innovation and dynamicity absorption. At the same time it is required to create linkage between external changes and the current organizational strategy. However it still prevails like a major decision to be taken in the milieu of large organizations. The cultural and team work constraints are enough significant that organizational strategy has a little space to roll over the sma ll changes (Slezek, 2013). Dynamicity absorption is suggested to attain through flexible mission and vision statements. In the conventional settings, it almost seems to be impossible to stick with the environmental changes along with implementing a rigid, long term and result oriented organizational

Week 4 discussion Essay Example | Topics and Well Written Essays - 250 words

Week 4 discussion - Essay Example Dean Borner a research associate in his interview on YouTube asserts that party affiliations of the voters are in contrast depending on racial and ethical groupings. Voters in these parties widely differ on ideologies, race, and age groups including genders-a factor that has widely grown in the fight against the gubernatorial seats. Borner adds that among the likely voters, majority are likely to be the Democrats, closely followed by the Republicans with the Independents remaining unsure of where to cast here ballots. The survey agrees with this view stating that likely voters are anticipated to be older, more affluent and educated with their nationalities being Americans. With all this factors in consideration, it is imperative to note that irrespective of the voter’s affiliations and Democrats perceived as winning the gubernatorial elections, there would be some effects on the outcome. It is quite clear that the state would lack a full representation of voters from other ethnicities who also have an opportunity to vote but are handicapped by factors that define a voter’s affiliation to a party such as nationality, wealth, age and race among others. Voting is like playing dice. Seven PPIC Statewide Surveys from September 2013 to July 2014, including 7,525 likely voters. California Secretary of State, Report of Registration, February 2014. U.S. Census, 2010–12 American Community Survey. Seven PPIC Statewide Surveys from September 2013 to July 2014, including 7,525 likely voters, 2,292 infrequent voters, and 2,007 unregistered adults. Definition of Surveillance Assignment Example | Topics and Well Written Essays - 750 words

Definition of Surveillance - Assignment Example The device is ideal for longer ranges detection. The parabolic dish aids intelligent officers to increase the sound for 40 decibels. It comes with an amplifier with connected earphones to enhance the quality. Intelligence officer finds it ideal for amplification of sounds that the naked ear cannot hear. The voice changer aids intelligent officers for masked voices. The changer is battery powered and connected to the phone with 8 voice settings. The sound amplifier is a high-tech microphone ideal for sound amplification (Brakel & Hert, 2009). Implied surveillance plays an important role is providing controlled information growth. The advantage is in the process of ensuring security first identifies the critical information of the company that will be important to plan. The disadvantage is in executing the security measures during critical times. Overt surveillance process is the analysis of threats; the company should be able to assess its ability to collect, process and analyze information, this will ensure the company knows exactly to what extent it is likely to suffer from possible threats. Covert surveillance process is to ensure that vulnerabilities are also analyzed; this should involve ranging them in terms of high, medium and low to help identify the weaknesses that can easily be used to exploit the security system. The clandestine surveillance process should also be able to analyze the type of information that the company offers. The disadvantage lies in the analysis of risks; here the threats and vulnerabilities are put on the comparison and help determine the potential risk that is posted. Extraluminal surveillance plays a role in maintaining vigilance. The advantage is in the assessment if the assessment shows that the level of vulnerability is high and the threat is evident, then exploitation is expected and the risk is assessed to be high and protective measures are  put in place.

Correlation between Self-Esteem and Memory Research Proposal

Correlation between Self-Esteem and Memory - Research Proposal Example The study employed standardized measures constituting a Rosenberg Self-Esteem questionnaire given to participants to be completed in class; followed by a series of fifteen words read aloud to them and to be written down on a sheet of paper shortly afterward to test their memory. This experiment used a within-subject design where the researcher tested the participants independently and analyzed their results in SPSS, running a Pearson Correlation Test to find any correlation. Several specific studies have highlighted many cases that demonstrate how memories affect self-esteem both positively and negatively. Psychologists have long been studying "Self-esteem" as an independent concept in cognitive-behavioral therapy, mistaking it as something characteristic of maladjustment in one's social environment. It was until only recently that Social Scientists like Rubenstein (1999) defined self-esteem as the "belief" that one is capable of making competent and appropriate decisions about his life. (p. 76) This belief, Rubenstein explains, is based on how we evaluate our actions where such evaluation is, in turn, driven by concepts such as memory and self-concept. Healthy self-esteem is achieved when people are able to validate their actions positively. (p. 76) Constituting one of the four components of self-concept, Carpenito-Moyet (2007) state that self-esteem has many types and kinds depending on several factors that are driven by experiences and memory (p. 563). Psychologists have discovered that self-esteem fluctuates as life events range from positive to negative incidents, where negative life events predict lower self-esteem (e.g., Lakey, Tardiff, & Drew, 1994). Sternberg and Mio, discussing autobiographical memory; which is the memory of an individual's history, state that experiences in the life of an individual are constructive, wherein one does not recall exactly what happened but one's own construction or reconstruction of what happened. (p. 237) Which brings us to the concept of what one "believes" to be true about himself. These investigations about autobiographical memory show that memories affect self-esteem especially when the individual has a distorted recall. There are several studies highlighting many cases that demonstrate how memories affect self-esteem both positively and negatively. One such study is that of Uttl, Ohta and Siegenthaler's (2006) introduction and study of the so-called "self-defining memories". Their study showed that, in the case of mother-daughter bonding, daughters that were narrated more positive birth narratives showed higher self-esteem and those, with more frequently told and descriptive stories were closer to their mothers than those who weren't told any positive birth narratives. Uttl, Ohta and Siegenthaler found support from a similar research on SDMs conducted by Cohen and Conway. Their studies led them to the finding that these memories have links to personality styles. For instance, there was the case that reported the way students at the end of their third year of college have described and evaluated a significant life experience from the preceding 3 years and how these correlated with their personality,

Edgar Allen Poe's The Cask of Amontillado Essay

Edgar Allen Poe's The Cask of Amontillado - Essay Example Montresor avenges some unspecified insult inflicted on him by Fortunato and thus buries him alive. Significantly, the cause for the murder is rendered insignificant and the maneuvers and the actual execution of murder gain prominence in the story. The paradigm of sacrifice enters the story in the instance where Montresor warns Fortunato against staying in the damp catacombs for the latter seems to have a cough. Fortunato’s reply that a cough shall not kill him compounds the irony in the story and anticipates his predicament. However, it also highlights a kind of unstated willingness on Fortunato’s part in the scheme planned by Montresor. There is a suggestion that Fortunato may have subconsciously accepted the fate which awaited him. It is here that the numerous parallels between Fortunato’s murder and Christ’s crucifixion enter the story. The theme of revenge drives the plot of the story. The metaphor which encapsulates this theme is the motto on Montreso r’s family coat of arms which proclaims Nemo me impune lacessit  ("No one insults me with impunity") (Poe, 99). The symbol which shows a foot crushing a snake while the snake’s fangs are set in the foot is reminiscent of Christian theology. The snake is often identified with the Adversary or Satan and thus represents the figure of the avenger in Montresor. Montresor can also be said to be reminiscent of Judas, Jesus’ friend who betrayed him. Fortunato’s meek submission to his fate and the heinous manner in which he was killed, coupled with his last words "For the love of God, Montresor!" (Poe, 101) yet again emphasize the theological underpinnings of the story. The unmistakable parallels between Christ’s death and Fortunato’s murder are seen also in the fact that Montresor kills Fortunato in the catacombs which are hallowed spaces. The very name Fortunato which means ‘fortunate or blessed’ seems to be ironic. Despite the many similarities in their predicaments, Fortunato unlike Christ lies in a desolate tomb, unknown to the world, without having accomplished much for the greater good of mankind. The many points of confluence and departure between Christ and Fortunato perhaps constitute a certain existential questioning that the story brings about regarding the place of virtue and sacrifice in the modern world. This rendition of Fortunato as a modern, albeit ironic adaptation of Christ is done by keeping the original insult inflicted on Montresor deliberately ambiguous. The fact that much of our understanding of the story is mediated by Montresor’s subjective opinion brings about a significant subversion of conventional spiritual or theological narratives in which the murderer or the sinner is seldom given a chance to express himself. It may be well said that journey undertaken by Montresor and Fortunato to the wine cellars and ultimately to the catacombs assumes the character of a pilgrimage. The ironic reversal however lies in the fact that the journey is made for the precious Amontillado and not for any ostensible spiritual quest. The murder of Fortunato further subverts the motif of the pilgrimage and conjures the image of aborted spiritual endeavors in the modern world. The spatial and temporal settings of Poe’s story significantly shape its thematic concerns. It is important to note that the story is set in an indeterminate year in Italy during the carnival of Mardi Gras. In

Dreams Research Paper Example | Topics and Well Written Essays - 1250 words

Dreams - Research Paper Example A study had been done to show how the lives of people can have a great effect on what and how they dream. After comparing what people go through and what they dream about, it has been determined that the events and situations that a person faces plays a big role in what they dream. A dream is a sequence of mental images, thoughts and feelings that involuntarily take place while an individual is sleeping. Sigmund Freud hypothesized the Dynamic Theory of Dream Formation to help explain what actually causes dreams to be formed. This theory states that dreams are constructed in the brain of a sleeping individual by unconscious impulses, or an incident or thought that had been silenced throughout the day that makes itself known as a underlying thought while the brain is resting. â€Å"Every dream is on the one hand the fulfillment of a wish on the part of the unconscious and on the other hand the fulfillment of the normal wish to sleep which sets the sleep going (Freud, 2003).† Rapid eye movement (REM) is a vital aspect of both sleeping and dreaming. REM is the standard stage of sleep that is distinguished by rapid movements of the eyes. This cycle of rapid eye movement contains two other categories: tonic and phasic. The rapid eye movement cycle is also characterized by low muscle tone and a swift, low voltage electroencephalography (EEG). Dominating brain waves are not present during the rapid eye movement cycle as the brain is not at its complete functioning level. In a typical night, individuals go though four or five bouts of rapid eye movement sleep, all of which totals an hour and a half to two hours at the maximum. Dreams take place during the rapid eye movement cycle as this is when the person is in the deepest of sleep. The dreams that most people are able to remember after waking up are those that are done during the rapid eye movement cycle. This is mostly due in part to the fact that it is common for people to wake up after

Price Elasticity Research Paper Example | Topics and Well Written Essays - 250 words

Price Elasticity - Research Paper Example The greater the percentage of income the commodity represents, the greater the elasticity because it will attract people’s attention as a result of its high cost (Moschandreas, 2000). If a commodity represents a small percentage of the consumer’s income, on the other hand, it will have little effect on demand, and is deemed to be inelastic. Therefore, the purchasing power of the consumer affects elasticity a great deal. Necessity also profoundly affects elasticity. If a product is necessary, that is, if one cannot do without a product, elasticity is reduced because people will still buy the product irrespective of the change in price (Ferrell, 2010). The availability of alternative goods affects elasticity. If a substitute good is close and readily available to the market, elasticity will be high since people will have the choice to switch to the attractive alternative. This can be necessitated by the slightest of changes in prices, and therefore largely affects elasticity (Ferrell, 2010). Substitute goods availability and reach is a factor that many companies look at in price consideration due to its massive impact on elasticity. Some factors have the least effect on elasticity. Though relative, the effect that these factors have is thought to be negligible. Time is one such example. Price changes that persist for short time periods affect the demand for a good, and subsequent sales far much less than price changes that hold for a long time. If a price change holds for a long time, elasticity is likely to be high since the customers will have time to find suitable alternatives (Moschandreas, 2000). Loyalty to a specific brand affects elasticity. This is so because if a consumer is loyal to a brand, elasticity is low as the variables that affect the product will not affect its demand. However, it s worth noting that with time and availability of better alternatives, loyalty eventually

Relativism and Morality Essay Example for Free

Relativism and Morality Essay We frequently make moral judgments about the actions of others. We proclaim that things like removing a wallet from someone else’s pocketbook on a crowded train; flying airplanes into the Twin Towers; and intervening (or not) in the Syrian war are wrong. According to Gilbert Harman, such judgments about people’s actions are defective because they lack relativity to the individual’s moral framework. (Harman, 1975) In ‘Some Moral Minima’ Goodman argues that â€Å"there are certain things that are simply wrong. † (Goodman, 2010) I contend that right and wrong are subjective, based upon elements of an individual’s belief system, and dependent upon the situation. In this paper, I will discuss theory based arguments to justify my disagreement with Goodman’s contention. When considering the theories of right and wrong, it is customary to think of them as absolute. If it’s wrong, it can’t be right or if it’s right, it can’t be wrong. It is only when we stop looking at these theories as absolutes that we can begin to explore the possibilities of moral, subjective and cultural relativity. I submit that a person’s actions are only right or wrong relative to their particular moral framework. It is wrong to kill is a statement that could be made by one based on his moral and/or cultural beliefs, thereby making it a true statement. However, the image becomes blurred when that same man is responsible for administering drugs to prisoners sentenced to death. Some would conclude that such acts raze his moral framework and change the truthfulness of the statement. I submit that, to make such a judgment absent the benefit of knowing the full extent of his moral beliefs would be flawed. There is the possibility that he defines killing and carrying out a death row sentence differently. Harman asserts that it is possible that when one says â€Å"It is wrong to steal† s/he is saying something true, but that when another says â€Å"It is wrong to steal† s/he is saying something false (Harman Jarvis Thomson, 1996). This theory, known as subjective relativity, is based on individual beliefs and on interpretation. An example of subjectivity in moral truth can be found in the classic tale of Robin Hood. On the one hand, Robin Hood describes the King’s taxation of the poor as stealing and states that it is excessive and, therefore, wrong. The judgment, based on his moral beliefs, is true. Robin Hood, however, justifies his own acts of stealing as charity, e. g. stealing from the rich to give to the poor. In this scenario, for Robin Hood to say stealing is wrong, he is stating a fact that is neither truthful, nor based on his moral beliefs. On the other hand, when looking upon Robin Hood’s acts of stealing through the King’s eyes, to conclude that Robin Hood is stealing and that stealing is wrong would be a true statement made by one who believes that stealing is wrong regardless of the situation. These examples are supported by both individualistic and subjective relativism. Richard Joyce contends that â€Å"individualistic relativism sees the vital difference as lying in the persons making the utterance. † (Joyce, 2007). In the Confucian school of thought, Mencius developed his philosophical theory on the contention that man’s nature is inherently good (Chan, 1996). Chan maintains that based on Mencius’ philosophy, â€Å"all men have a mind that cannot bear human suffering. † According to Chan, Mencius expounded on this position in the following excerpt. [w]hen men suddenly see a child about to fall into a well, they all have the feeling of alarm and distress, not in order to gain friendship with the childs parents, nor to seek the praise of their neighbors and friends, nor because they dislike the reputation (for being un-virtuous)†¦[t]he feeling of commiseration is the beginning of the feeling of love; the feeling of shame and dislike is the beginning of righteousness; the feeling of deference and complaisance is the beginning of wisdom. Men have these four beginnings just as they have four limbs. These four, love, righteousness, propriety and wisdom are not drilled into us from outside. We are originally provided with them. † (Chan) In light of the information presented herein, the theories of right and wrong are subject to cultural beliefs and moral individuality. It is my belief that subjectivity is most prevalent in making this determination.

The schools of organization theories Essay Example for Free

The schools of organization theories Essay The schools of organization theories serve as the poles of support in keeping the order in an organization through the organizational functions. Each school of thought functions in a unique way causing changes in a certain work environment. The four schools of organizations theories that were listed are the human relations approach, neo- human relations school, the theories X, Y and Z (also known as the theories of motivation) and the systems approach. Major organizations that make use of the said theories include the finance undertakings, operations or productions, marketing and personnel purposes. These functions must be executed effectively and efficiently to be able to achieve the organization’s objectives. The organizational theories are manifested to almost all functions but in order to see a clearer perspective, specific reflections of the theories to each organizational function will be laid down. The human relations approach applies to the personnel functions. It dwells on the change of relationship between the leader and the subordinate. There is existence of decentralization and decision-making which let the employees be involved to enhance skills. The neo- human relations school is the â€Å"upgraded† version of the human relations school. Thus, it can also be reflected in the personnel functions. The said organizational theory patterns its principles to the Maslow’s hierarchy of needs. But, viewing form another perspective, the theory can also be utilized through meeting the goals of the marketing division. In marketing processes, advertising of a certain business entails the consideration of psychological aspects. In considering which marketing strategy to use, getting the consumer to respond to a certain product is important. This can be done through highlighting the achievement of human needs in an advertisement. For example, a television advertisement about a body spray targets the market segment of teenagers. So, the advertisement will highlight the need of teenagers to gain self-esteem through showing scenes in the advertisement that once a teenager will use that body spray, he or she will gain admiration from the opposite sex. Therefore, if and when the message was conveyed to the target market, the marketing function of the business will be accomplished. The third school of organizational theory is composed of the Theories X, Y and Z which somewhat clash in the purposes of managing the workplace. But, these are of great help in managing again the function of the personnel division. Theory X deals with a stricter work ethics to motivate the employees while Theory Y stated that workers have indeed a sense of self-direction. On the other hand, Theory Z (the hybrid of the Japanese and American management), incorporates the principles of creating a strong bond between the company and the employees through valuing the human resource development. Lastly, the systems approach is manifested through the technical functions of finance and production. The theory caters the requirements for financial matters through the open and closed systems. The open system as the name speaks for itself, caters boundaries that can be penetrated while the closed system has more rigid boundaries. It is up to the financial management on whether adjustments will be done in investments through accepting the influence of external factors or keeping everything as internal matters. For the operations or productions, the company can decide on whether adopting an open or closed system. Manufacturing lines can be subject to the transformation model if there is demand to do so. The company or the business can adapt the organizational theories for further improvement but it must be noted that some concepts of the theories can also hinder progress. As for the human relations and the neo-human relations approach, a concrete line must be drawn so to not abuse the professional ethics. It is true that the two theories give utmost importance in establishing individual autonomy to the employees, the leaders or managers must still be able to exercise power over major organizational matters. There must only be a right dose of relationship-oriented activities so that the work-related activities will not be overpowered. Otherwise, the sense of leadership will be obliterated. The theories X and Y must be adapted in a careful manner since the two are polar extremes. If Theory X is implemented in a leadership aspect, rebellion might occur in the workplace due to very authoritarian rules. The leader may solicit suggestions from the workers but still ahs the power to decide on whether to accept those suggestions or not. With this kind of management, conflict will definitely arise since the workers might think that the efforts are just put to waste. It must be made sure that the intensity of implementing it is well-adjusted to the needs of the organization. Theory Y does leadership in a lighter way but if the leader trusts the wrong people in the management to do specific tasks and these employees failed him, the quality of output will be affected. Theory Z may be taken in a brighter light so there may be fewer complications. It encompasses long term employment, specialized career paths and other holistic concerns for the employees. The theory may seem to be idealistic but there will still be conflict since the workers will be the one who will resort to solving the issues. Hence, managers won’t be touching issues causing poor control over matters. Finally, the systems approach can help in outsourcing ideas but then again, accepting changes pose the risk of having a negative feedback. The transformation may also alter some organizational traditions. The schools of organizational theories take on an effect of a double-edged sword. Some may help in facilitating tasks while some may worsen given situations. In a keen manner, the right theory to adapt for the company should be identified. The implementation of plans must of course go hand in hand with good management. References: Pugh, D. Methods for Detecting Exoplanets

Methods for Detecting Exoplanets A discussion and comparison of the radial velocity method and the transit photometry method of detecting exoplanets. An exoplanet is a planet that is outside of our solar system orbiting another star, and so far (at 15/01/2017) 3560 exoplanets have been detected [1]. Currently, with modern technology, the two main ways of detecting an exoplanet is using either the radial velocity method or the transit photometry method, both of which having their advantages and disadvantages. Radial velocity works by the exoplanet having a gravitational effect on the star it is orbiting causing the star to move slightly, leading to its detected light spectra being periodically shifted between red-shift and blue-shift as the planet orbits it. The minimum mass can then be calculated from the stars light spectra. Transit photometry can be used to detect exoplanets by observing a periodic reduction in the intensity of light detected from a star caused by the planet going directly in front of it between the star and the earth. The size of the planet can be worked out by measuring the decrease in light and sometimes the composition of the planet can be deduced The radial velocity method, also known as the Doppler spectroscopy method, to detect exoplanets was the first proper method that worked effectively. Orbiting planets cause a star to move slightly due to their gravitational pull, since the planet has mass. This slight movement of the star being orbited affects the light spectrum from that star which is received by observers on Earth. Regular periodic shifts in the stars expected spectrum, which would appear as a wobble, indicates the presence of an orbiting planet [2]. If the exoplanet caused the star to move towards Earth then its light spectrum would be blue shifted, if the star moved away from Earth the spectrum would be red shifted. The mass of the orbiting planet can then be determined, as Kelpers third law of planetary motion can be used to determine the orbital radius of the planet from the mass of the star, calculated using a Hertzsprung-Russell diagram, and the orbital period of the planet determined from the stars light spectrum. Then Newtons law of gravitation and the orbital law can be used to derive the equation to calculate the velocity of the orbiting planet. With the velocity of the planet, the equation can be used to work out the mass of the detected planet [3]. Using radial velocity is the most common method used to date to detect exoplanets, it has the advantage of not necessarily a very long time comparative to the other methods and is thus useful in large scale surveys to find multiple exoplanets. Unfortunately, it does not give much specific information about the planet itself and hence must be combined with other techniques to obtain information like the planets chemical composition, density, and volume. Other methods could thus have more potential for the future for more in depth analysis of the detected planet [4]. One major complication with radial velocity is that it is difficult tell mass of a detected planet easily, only the minimum mass based on how much star appears to move can be calculated, as it depends on the angle of the orbital plane of the planet. If the angle, ÃŽÂ ¸, is the angle made by the plane perpendicular to the orbit of the planet from the plane of the sight from Earth, then the component in line with Earth is sin(ÃŽÂ ¸). The detected mass, M, is thus the product of the actual mass of the planet and sin(ÃŽÂ ¸).ÂÂ   The larger ÃŽÂ ¸, where 0 [5]. This gives arise to the problem that on a rare occasion a low mass star can be detected in a binary star system and mistaken for a planet due to a mass being calculated much smaller than its actual mass and thus appears more similar to that of a planet because of the plane of its orbit with respect to earth. This method mainly detects planets that are very close to the star, massive, and have very short orbital periods so cause the largest wobbles that dont take very long to detect. Planets like this are often referred to as hot Jupiters, due to them being of similar size, mass, and composition to that of the planet Jupiter in our solar system but they are much closer to the star they are orbiting, hence being hotter [6]. A downside of this is that one of the main purposes of detecting exoplanets is to find planets capable of supporting life, and hot Jupiters are very unlikely to do this. Another main method of detecting exoplanets is called transit photometry. A planet may be detected by taking measurements of the dimming of light emitted by the star it orbits. When the planet passes directly in front of the star, as seen from Earth, it blocks out a fraction of the light that we receive. If this dimming occurs at regular intervals, then it may be deduced that this planet is in orbit and passing in front of the star once every orbital period [7]. The amount of dimming that occurs reflects the ratio of size between the star and planet; since the size of such a star may be determined from its spectrum we may then estimate the planets size. For planets orbiting the same sized star with the same luminosity and same light emission spectra, planets orbiting it will decrease the amount of light received on earth by different amounts depending on the size of the planets [8]. A planet with a radius three times larger than another orbiting planet will lead to a drop in the amount of light received nine times that of the other planet. Hence, the decrease in light received from the star due to a planets transit is proportional to the square of the planets radius and so proportional to the planets cross-sectional area. When this method is combined with radial velocity analysis which gives an estimated mass, the density may be calculated, giving a much clearer picture of the composition of the planet. The planets atmospheric conditions may also be uncovered by analysing the depth of the transit at different wavelengths of light. Light emitted by the star will be absorbed by gases in the planets atmosphere to different degrees at different wavelengths [9]. Therefore, by studying its spectra elements in the atmosphere may be determined. For such analysis to be carried out, searches must continuously cover large portions of the sky and its cluttered light sources over long periods of time. Transit photometry only works, however, when a planet passes directly between its star and the Earth, which is uncommon. For a star one astronomical unit (approximately about 150 million kilometres) away from its star, and the star being the same as the sun earth orbits, the probability of an orbiting planet producing a detectible transit is 0.47%, given that the planet has a random orbital alignment [10]. A planets orbital period could be a very long time, months, or years, but its transit directly in front of the star between it and earth could only be a couple of hours.ÂÂ   Despite this, in very large scale exoplanet finding surveys spanning over extended periods of time and covering potentially thousands of stars, the transit photometry method has been found to be more effective than the radial velocity method at finding a larger number of exoplanets [11]. However, transit photometry has a much larger detection rate of false positives, meaning an exoplanet was thought to be detected using this method but after further investigation was found to be a false detection. A 2012 study found that in single planetary systems, the number of false detections was up to 40%, based on the observations from the Kepler mission [12]. This means that, in the case of single planetary systems, a planetary detection using transit photometry must be verified using another method, which is often radial velocity and sometimes the less common method of orbital brightness modulation. Fluorides Essay -- Health, Dental Access

Fluoridation: The Big Debate The issue of fluoridation has always raised big questions regarding its effectiveness, safety and usage. Some of the main pros and cons of fluoridation shall therefore be explored. Pros: Large Reach: All members of the community would have access to regular fluorides doses, regardless of income, education or dental access. It many be particularly beneficial to children, as studies have shown that they do not brush as regularly as they should. Therefore, the omission of this administration fluoride can be compensated through water fluoridation, which all children should and would drink. Advantageous for the Elderly: As you get older, one’s saliva flow would generally decrease. This would mean that the elderly have less salivary fluorides that could access, remineralise and strengthen tooth surfaces. Moreover, the elderly have decreased manual dexterity to brush effectively and reach all surfaces. Therefore, all of these issues increase the risk of root surface decay for the elderly, but fluorides would help prevent this from occurring. Evidence: Many studies have been carried out to show that fluoridation of water does have a positive impact on oral hygiene and helping to prevent dental decay. Support: The fluoridation of water is supported by large health bodies such as: The British Dental Association; The World Health Organisation; The British Medical Association; and the British Fluoridation Society. Cost Effective: The use of fluorides reduces the risk of dental caries, and so potentially saves money for a patient who otherwise would have had to have payed for fillings. Reduces the Risk of Dental Caries: A recent study has concluded that adding fluoride... ... consuming hot or cold substances.[45] 5 things required for remineralisation of tooth enamel[36] The correct minerals (containing Ca2+, PO43- and Fl- ions) must be present in one’s saliva. Carbonic acid must then be produced (naturally produced from carbon dioxide and water) and close to the minerals, so it reacts with and dissociate them into their constituent ions. This process must take place near the tooth area affected. The affected demineralised area of hydroxyapatite must be clean and accessible. Complementary shaped ions formed from the minerals can then attract to oppositely charged ions within the hydroxyapatite lattice. Carbonic acid must then reform carbon dioxide and water, which precipitates the complementary ions that were dissolved in it into the area of demineralised enamel. In this way, remineralisation of the tooth enamel has occurred.

The Dangerous Combination of the Media and the Weight-Loss Industry Es

The Dangerous Combination of the Media and the Weight-Loss Industry    Abstract: Excessive use of diet pills by American women stems from the idea that thinness is ideal. This ideal is unlikely to change in the near future, so the use of diet pills and other unhealthy fat diets is likely to increase. If women remain unaware of the health risks associated with the use and abuse of these unregulated drugs, rates of illness and even death are also likely to increase. In 1997, the use of diet pills directly caused seventeen deaths (Cohen). Medical professionals speculate that many other deaths are indirectly related to weight-loss drugs. FDA regulation of 'natural' substances such as ephedrine and caffeine would alleviate widespread use of diet pills. Without such regulation, advertisement of these drugs will continue to entice young women to unintentionally abuse their bodies and risk their health. Depictions of women in the media have expressed thinness as perfect for the past few decades, and the thin ideal is becoming more extreme. The 'waif model' is common in magazines, on television, and on the runway. Although these individuals are considered underweight by medical evaluation, their appearance has become desired by the average American woman. Oddly, even as Americans have aspired to weigh less, our average weight has increased by more than ten percent since the early 1970s (Berg 29). This weight gain probably results from the high fat content in popular, condensed foods. This inadvertent weight gain, coupled with increasing desire for thinness, has created an enormous market for 'fad diets.' One variety of these diets is the use of diet pills. Food inc Essay

Food, Inc is a film that lets people in on the food production in American. The film opens up in a grocery store, which has pictures of farmers giving you the idea that the food you are going to purchase is farm raised. However the film calls it a pastoral fantasy. Even though people would like to believe that their food is coming from a farm where that animal is raised the correct way that is not always the case. This film dug into certain aspects of food giving you the ins and outs on how all types of food is produced. This film is not trying to make someone turn in to a vegetarian. It is simply trying to inform people how food production has changed over the years. Something said in the film was that â€Å"it’s not farming anymore, it’s just mass production. Chickens today are genetically modified to have larger breasts since the consumer preference is white meat. A lot of these companies are injecting hormones in these animals to speed up the growth process. Where before a chicken life span was around 80 days, with this hormone being injected it knocks about 20 days off now. The faster the chicken grows, the more chicken can be produce at a faster rate. The chickens grow at such a fast rate that their bones and organs can’t keep up with the rapid growth of the muscles, or the meat. Mention in the film is that McDonalds is one of the largest purchasers of ground beef, potatoes, pork, lettuce and tomatoes. Fast food nearly started with McDonald’s. When they decided to make things easier their menu and hire employees that repeated one task over and over for minimum wage, the result was the fast food occurrence that cleaned the United States. Mention in the film â€Å"Eating meat produced by the system†. As long as people continue to eat meat that is not properly raised or properly killed we will continue to have the problem of how food is produced. The industry does not want you to know what you are eating. So they will sell you this dream that everything is farm raised, when in reality their feeding cows corn that produces infections, giving chickens hormone injections to speed up growth process. There’s nothing farm raised about these tactics. Joe Salatin says â€Å"Meet the need without comprising integrity†. There are ways food can be produced without all of the extra stuff. Salatin does his farming and killing outside. People have tried to get him shut down saying the way he produced chicken was not sanitary, but yet other companied that do produce meat has had infected meat even with them being in a factory. People drove over 100 miles just to purchase Salatin’s chicken. This says a lot; people do want quality produced food. The average farmer used to feed 6 to 8 people, now it is up to 126 people. If we had more farmers who practice Salatin’s techniques then we would be able to produce more. If there was not so much meat being produced then maybe people would not buy so much in abundance and meat would not have to be produce so fast and in large quantizes. People buy a lot because it is overly produce in my opinion. If food was not so readily available then maybe it would not be over consumed. As long as food is purchased in abundance companies will continue to produce food the way they do to keep up with how much food people are purchasing.
